The site is operated by the Contemporary Arts Trust (We or Us). We are a UK registered charity with UK registration number 1168806. We are based at 5 Bloomsbury Square, London WC1A 2TA. You can find out further details about us on the Charity Commission website at www.charitycommission.gov.uk.

Our charitable purposes are: to promote maintain improve and advance education in the arts generally for the benefit of the public and to encourage the arts and their development within society and in particular by the encouragement of sculpture, painting, drawing, design, lithography, printmaking, graphics, poetry, literature, film, photography and music (together, Charitable Purpose(s)).

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at support@ContemporaryArtsTrust.org.

Ownership

The materials, content and information on the Events page of our site (Events Content), including all rights in the Events Content, are owned by third parties. The Events Content is provided for interest and guidance only and you are not authorised to copy or reproduce it in any form.

Aside from the Events Content, we are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

Use

You may view, download for caching purposes only, and print pages from the site for your own personal use, subject to the restrictions set out below and elsewhere in these terms of use. You must not:

(a)            republish material from this site (including republication on another website);

(b)            sell, rent or sub-license material from the site;

(c)             show any material from the site in public;

(d)            reproduce, duplicate, copy or otherwise exploit material on our site for any commercial purpose;

(e)            edit or otherwise modify any material on the site; or

(f)              redistribute material from the site except (where applicable) for content specifically and expressly made available for redistribution by us – which shall be subject to such restrictions and other terms as we may determine in our discretion.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged.

If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

Reliance on information

The content on our site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site. This is particularly true of the Events Content, which you must check and verify with the originator of the Event Content, such as the venue, gallery or organisation running the event.

Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up to date.

To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to this site and the use of this site (including, without limitation, any warranties implied by law in respect of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill).

 

We are not responsible or liable in any manner for any user content or any content posted on our site by third parties. We do not control and are not responsible for what users or other users post, display, upload, publish transmit or share on our site. We are not responsible for the conduct, whether online or offline, of any users our site, whether registered or otherwise.

Uploading content to our site

Whenever you make use of a feature that allows you to upload content to our site, or to make contact with other users of our site, you must comply with the content standards set out in our Acceptable Use Policy.

You warrant that any such contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

Any content you upload to our site will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you are required to grant us and other users of our site a limited licence to use, store and copy that content and to distribute and make it available to third parties. In the case of the granting of an award, prize or other donation, the recipient grants us the said licence to use an image of the relevant work(s) for all purposes connected with our site and for our Charitable Purposes.

We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy.

We have the right to remove any posting you make on our site if, in our opinion, your post does not comply with the content standards set out in our Acceptable Use Policy.

You are solely responsible for securing and backing up your content.

Membership & donations

Membership fees are payable on an annual recurring basis. Unless cancelled on no less than thirty (30) days’ prior written notice your membership will automatically renew on each anniversary and you will be liable for the then applicable annual membership fees. You hereby authorise us to take payment of the membership fees using the payment method used when you began your membership, such as credit card or direct debit, or any updated or recent payment method provided by you.

All membership fees, donations and other payments or contributions will be used at the discretion of the trustees for or in connection with the Charitable Purposes, which include (but are not limited to) the following:-

  • Sponsoring artists
  • Prizes
  • Awards
  • Exhibitions
  • Competitions
  • Bursaries
  • Assistance with studies/tuition
  • Administration and operation of the trust

 

Where donations or other payments are given for specific agreed purposes, such as prizes, recognitions or awards for certain achievements in specific areas of the arts, the trustees will use all reasonable endeavours to use the donations for the agreed purposes.

Where bursaries, scholarships and assistance for students, academics and lecturers are awarded, the recipients are chosen by the relevant institution(s) and we are therefore not responsibile for the selections made or the basis or criteria for the said selection.

When judging prizes and awards, expert judges may be asked to participate in the process of selecting the prize-winners.

We are not responsible for websites we link to

Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.

We have no control over the contents of those sites or resources.

Our responsibility for loss or damage suffered by you

Nothing in these terms will: (a) limit or exclude our or your liability for death or personal injury resulting from negligence; (b) limit or exclude our or your liability for fraud or fraudulent misrepresentation; (c) limit any of our or your liabilities in any way that is not permitted under applicable law; or (d) exclude any of our or your liabilities that may not be excluded under applicable law.

The limitations and exclusions of liability set out in this section and elsewhere in these terms: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under these terms or in relation to the subject matter of these terms of use, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.

To the extent that the site and the information and services on the site are provided free of charge, we will not be liable for any loss or damage of any nature.

We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control.

Please note that we only provide our site for domestic and private use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We will not be liable to you in respect of any loss or corruption of any data, database or software.

We will not be liable to you in respect of any special, indirect or consequential loss or damage.

We are not responsible for viruses and you must not introduce them

We do not guarantee that our site will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

Rules about linking to our site

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

Which country’s laws apply to any disputes?

If you are a consumer, please note that these terms of use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

If you are a business, these terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.

Our trade marks are registered

‘CAT’, ‘Contemporary Arts Trust’ and the ‘CAT Logo’ are UK trade marks which are used and owned by the Contemporary Arts Trust. We are also the owners of UK trade mark registration number UK00003170138 for the Contemporary Arts Trust & logo. You are not permitted to use our trade marks without our approval.
